• uBetWHAT offers a service whereby Users can offer a challenge or take up a challenge posted on uBetWHAT’s website, or both.
• uBetWHAT reserves the right to modify, suspend or discontinue any or all of uBetWHAT’s services at uBetWHAT’s sole discretion and without notice.  uBetWHAT also reserves the right to give advanced notice of any changes to these terms and conditions at any time, whether by notice on uBetWHAT’s website or by contacting the Users directly.

• From time to time, certain provisions and rules will change; these will be updated accordingly.  Notification of each such change will be posted within uBetWHAT’s site.

• To avoid doubt, if a User makes an offer or takes up a challenge, the User does so with another User.  uBetWHAT is not to be considered a party to any contractual agreement made by or between uBetWHAT Users and other uBetWHAT Users.  Users enter into a contract with other Users and not uBetWHAT by making an offer or responding to a challenge on uBetWHAT’s website.

•  All Users agree to hold uBetWHAT, its agents and employees harmless from any and all liability, regardless of the cause of action, whether in contract, tort (including negligence and breach of statutory duty), strict liability or otherwise whatsoever for any special, indirect or consequential damage of any nature whatsoever arising directly or indirectly out of the services uBetWHAT offers.
• uBetWHAT does not offer any warranties or guarantees with respect to its services.
• uBetWHAT’s website contains links to other Internet sites.  uBetWHAT does not review all of the sites that are linked to uBetWHAT’s web site for their content.  If you use a link that connects to another site, you do so at your own risk.  uBetWHAT cannot be responsible for the way in which other websites deal with issues of privacy.  In addition, the links on uBetWHAT’s website do not indicate that uBetWHAT endorses the content, products or services of the advertisements.

• There are a number of important requirements for a User to register with uBetWHAT:

--Further, uBetWHAT reserves the right to refuse to register anyone without reason.  In addition, uBetWHAT reserves the right to terminate or suspend any User’s registration.

--When uBetWHAT confirms acceptance of your registration, you will be required to give us a User name and password.  uBetWHAT will advise you if the User name and/or password you have chosen have already been taken.  If either has been taken, you will be asked to submit a new User name or password.

--You agree to keep these details confidential.  This is because you will use your User name and password to offer a challenge or take up a challenge posted on uBetWHAT’s website.  uBetWHAT does not, under any circumstances, accept liability for the use of your User name or password by a third party. 

• If you have queries with any transactions—please email us at customer services stating your User name.  uBetWHAT can only acknowledge and reply to account queries coming from the email address specified in your account details.  This is for your security.
• uBetWHAT operates a number of security checks to ensure that Users on the site cannot defraud uBetWHAT or other Users.  uBetWHAT reserves the right to block or suspend any User’s account that is suspected of fraudulent activity and may pursue criminal proceedings.
• uBetWHAT wishes to assure you that uBetWHAT is committed to protecting your right to privacy.  To this extent, the information you provide to us will be stored in accordance with the Data Protection Act of 1998.  uBetWHAT will only deal with your information in accordance with the terms of this Act.
• uBetWHAT shares certain information it gathers with advertisers and other partners.  The information uBetWHAT shares comprises information in aggregate form only.  uBetWHAT does not share personal information about any Users unless uBetWHAT has your specific permission to do so.
• If you wish to know what information of yours uBetWHAT holds, please contact us.  If you wish us to amend or change the information uBetWHAT holds, we will do so upon your request.  Historic information will remain on file for auditing purposes.
• A User may enter a Challenge in relation to a listed Challenge on uBetWHAT’s website, or author their own new Challenge.  Once a Player has selected a Challenge, entered the details of the Challenge he proposes (including his selection) and details of the Challenge have been accepted for entry on the uBetWHAT website, the Challenge details may not be altered.  However, the User may close the play before the expiry time if the entire challenge is accepted.
• In the event of no User accepting the Challenge before the stated closing time, the Challenge shall be deemed lapsed and may not thereafter be accepted.
• In order for a User to be able to exercise his/her judgment and skill in deciding whether or not to accept an offered Challenge, historic data as is available to the User making the Challenge including the opposing player’s play history with other members about the perceived honesty of the opposing member.
• Data relating to a User is provided solely to assist other Users considering accepting the Challenge offered and/or in deciding whether or not to accept and shall not include the User’s name, address or any details by which he/she may be identified.
• The closing time shall be shown on all Challenges.
• Due to the often unconfirmed, unfixed and changeable starting times of events such as tennis matches or individual boxing bouts, it is possible that an event may start before the bet is closed.  It is the responsibility of the author of a Challenge to select a close date/time which is earlier than the start of the event or to revise the close date/time and close play before the start date/time of an event.
• It is your responsibility to check the outcome of a Challenge to which you are party and place your vote for the appropriate winner.
• The outcome of any event shall be that declared by two individual members involved in the Challenge.  If there is a dispute between the two individuals, then the members of uBetWHAT will vote on the outcome.
• If an Event is cancelled or abandoned before completion, the event is declared void—except where a particular Challenge is completed prior to cancellation or abandonment.

USER RULES

A User agrees and becomes a party to the following rules by: (a) entering the uBetWHAT website, (b) opening an account at uBetWHAT, (c) playing on uBetWHAT, (d) use and reuse of such an account, (e) participating in challenges, or (f) acceptance of any challenges.

User hereby represents, warrants and certifies all of the following:

• The User fully understands, agrees to, becomes a party to, and shall abide by all rules, regulations, terms and conditions contained herein, and that such rules, regulations, terms and conditions may change from time-to-time.
• Users shall not use this site for any illegal purpose and if it is determine a User has violated the laws of any government uBetWHAT will and is obligated to report said illegal activity to us and the appropriate law enforcement agency.
• User shall refrain from obscene or illicit activities.  Such conduct will result in suspension of the User's privileges to the uBetWHAT site.
• The User shall not allow any other person or third party including, without limitation, any minor, to participate in the games.  In such event uBetWHAT is not liable.
• Playing at uBetWHAT is prohibited to all employees of uBetWHAT, and their immediate families.
• The User shall hold the Company, its employees, officers, directors, licensees, distributors, wholesalers, affiliates, subsidiaries, advertising, promotion or other agencies, media partners, agents and retailers harmless and shall fully indemnify the same from any and all costs, expenses, liabilities and damages whatsoever that may arise as a result of User’s: (a) entry, use, or reuse of the uBetWHAT website, (b) use of any materials at the website, (c) entry, use, or reuse of the uBetWHAT Server, (d) participation in the event, or (e) the acceptance of any Prize/Winnings.
• User’s interest in the uBetWHAT website and games is personal, and not professional; Users entering the site do so solely for User’s own personal entertainment and any other entrance, access, use or reuse of the uBetWHAT website by User is strictly prohibited.
• Play at uBetWHAT, as real or guest User is intended for the use of adults and for entertainment purposes only.
• Promotional bonuses are distributed to Users at uBetWHAT’s sole discretion, as a benefit of playing at uBetWHAT.
• uBetWHAT’s Promotions Department will be the sole judge of any promotion.  uBetWHAT reserves the right, exercisable in its sole discretion, to discontinue or cancel any promotion at any time for any reason whatsoever and without prior notice.  Any person deviating from the promotional rules may be disqualified.
• uBetWHAT’s Management reserves the right to refuse participation in any promotion at its sole discretion, without prior notification.
• By agreeing to these terms and conditions, you are bound by the entirety of this agreement and by uBetWHAT’s “Rules and Regulations” and “Privacy Policy” that are incorporated by reference into these terms and conditions.  If there is any inconsistency between these terms and conditions and any document incorporated by reference, these terms and conditions will prevail.
• If uBetWHAT changes these terms and conditions, uBetWHAT will take appropriate steps to bring such changes to your attention (such as by placing a notice of such change on a prominent position on the website, together with the changed terms and conditions).  Your continued use of uBetWHAT services after such amendment and notification will be deemed to be your acceptance of the changes to the terms and conditions.  Any challenges matched prior to the time of amendment and notification of the changed terms and conditions will be subject to the pre-existing terms and conditions.
• You understand that by using uBetWHAT’s services you may not bet money or possessions on challenges placed.
• You understand that you are responsible for deciding the results of Challenges, which you are a party to by voting for the outcome.  If you fail to vote for a Challenge you are a party to within 7 days from the time your opponent votes, your vote will be cast automatically to agree with the other member.
• You agree to provide accurate registration information.  You agree to inform us of any changes in such details.
• You will inform us as soon as you become aware of any errors with respect to your account.

• When you register with us via the website, upon completion of registration, uBetWHAT will confirm by electronic mail to the address you have supplied that your uBetWHAT account is open.
• You agree to inform us at once by electronic mail or telephone if you believe that your account information is being misused by a third party so that uBetWHAT may suspend your uBetWHAT account.
